These Terms of Service ("Terms") outline the use of Kiva ("the app") and govern your relationship with the Owner in a legally binding way. Please read this document carefully.

Although the contract between Users and the Owner is entered solely by them, if you obtained Kiva through the Apple App Store, Apple may enforce these Terms as a third-party beneficiary.

Medical Disclaimer

Kiva is not a medical device or medical service. The app provides health and wellness insights for informational and educational purposes only. This includes, but is not limited to, biological age estimates, longevity scores, athletic age, blood test analysis, and AI-generated health insights.

This information is not intended to diagnose, treat, cure, or prevent any disease or health condition. Always consult a qualified healthcare provider before making changes to your diet, exercise routine, or health regimen. We strongly encourage consulting your healthcare provider before using the app.

You represent that you are in a condition suitable for using the app, which may involve changes to diet, activity, or other lifestyle factors.


Data Policy

What We Collect

We collect the following data when you use the app:

  • Account information: Name and email address (via Sign In with Apple)
  • Health and fitness data: Data you authorize us to read from Apple Health (HealthKit), including heart rate, steps, sleep, exercise, blood pressure, and other health metrics
  • Nutrition data: Meals and food items you log in the app
  • Blood test data: Lab values you manually upload (encrypted at rest)
  • Usage data: Anonymized analytics about app usage (screens viewed, features used)

How We Store It

Your data is stored in Google Firebase Firestore (cloud) and locally on your device. Sensitive fields (such as blood test data) are encrypted using AES-256-GCM before cloud storage.

Third-Party Services

The app uses the following third-party services that may process your data:

  • Google Firebase — authentication, cloud storage, and anonymized analytics
  • Anthropic Claude — AI-powered health analysis (Elite tier only; only aggregated health metrics are sent, no personally identifiable information)
  • Apple HealthKit — health and fitness data (with your explicit consent)
  • Apple StoreKit — subscription and purchase processing

What We Do NOT Do

  • We do not sell or rent your personal data to third parties
  • We do not share your data with advertising networks or data brokers
  • We do not use your data for third-party advertising

Subscriptions and Payments

Auto-Renewable Subscriptions

Kiva offers auto-renewable subscriptions:

  • Monthly plan
  • Annual plan
  • Elite Annual plan (includes AI Health Team features)

Billing

  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate
  • You can manage and cancel your subscriptions by going to Settings > Apple ID > Subscriptions on your device

Free Trial

If offered, any unused portion of a free trial period will be forfeited when you purchase a subscription.

Refunds

For purchases made via the Apple App Store, refunds are processed per Apple's refund policy. For other inquiries, contact us at contact@kivahealth.co.


Terms of Use

Unless stated otherwise, these Terms apply broadly to all Kiva users. By using the app, Users confirm the following:

  • No restrictions on Consumer or Business User status
  • Users are not located in a country under U.S. Government embargo or designated as "terrorist-supporting"
  • Users are not on any U.S. Government prohibited or restricted party lists

Content Rights

Unless otherwise noted, all content on Kiva belongs to the Owner or its licensors. All intellectual property rights are reserved by the Owner.


Acceptable Use

Users are solely responsible for ensuring that their use of Kiva complies with applicable laws. The Owner reserves the right to deny access, terminate contracts, and report misconduct.


Your Rights and Data Deletion

You have the right to:

  • Access your data by contacting us
  • Request deletion of your account and all associated data by contacting us at contact@kivahealth.co
  • Revoke Apple Health access at any time in iOS Settings > Privacy & Security > Health
  • Revoke Sign In with Apple at any time in iOS Settings > Apple Account > Sign-In & Security > Sign In with Apple

We will process deletion requests within 30 days.


Limitation of Liability

To the maximum extent allowed by law, the Owner is not responsible for indirect, incidental, or consequential damages arising from the use of Kiva. The app is provided "as is" without warranties of any kind.


Governing Law

These Terms are governed by the laws of the Owner's state of residence, with disputes resolved through the courts of that state.


Modifications

The Owner reserves the right to change these Terms. Users will be notified of material updates via the app or email and prompted to accept the revised Terms.
